I am most likely going to be discharged from the National Guard for medical reason, What will happen?

I have been in the guard for nine years about 3 active. I have one tour in Iraq and recieved the purple heart. I am 50 percent disabled through the VA. What Benefits (if any) should i be looking into? what is the process like? and how long does it take? Any information would be helpful... Thanks

Reply:ok here hos it goes . if u have been told u r 50 percent disable from the va then u have been discharge cause if not the hopspital and the ijury and what the doctors told u . the only way the va can determin that is that u already started the paper work through them and have been seen throughthem.and if u 50 percent u will be discharge from the Guards.due to u can not pass the prt test. and u will then have to take all info u have including your dd214 to the local va and start the required paper work .i am a disable vet also . and i have been 30 percent disable and now reciev a pension from the va each month. so u need to check with them unless the National Guard can put you on a desk job if u need any more info please email at myke_cyndy@yahoo.com. and also more info can be found at www.va.gov
Reply:There appears to be a disconnect in the information your provided. If yours is a service-connect disability ratable at 50% you should have appeared before a medical evaluation board, followed by a "records-only" appearance before a physical evaluation board and a transfer to the disability retired list under the provisions flowing out of Title 10 of United States Code. Not a "medical discharge" and receipt of disability payment from the VA flowing out of Title 38 United States Code. In short, it's apples and oranges.

Anyone with a ratable disability of 30% or more which is service-connected (3 years or more active duty is a presumption of service connection) and identified during one's term of service is one which requires transfer to the disability list. Especially if it is related to a period of service in which you were "federalized" and mobilized.
